From January 1, 2009 through December 31, 2009 (the “Entry Period”), Levenger Company will conduct a national Sweepstakes. You can enter this sweepstakes either by phone, online or by completing an entry form at a Levenger Retail store. Online Entry: To enter the sweepstakes via the Internet, go to www.levenger.com: If you have already given Levenger your email address, then you are automatically entered into the Sweepstakes. You must give Levenger your email address and submit it during the Entry Period. To enter the sweepstakes by phone, please call 800-544-0880, 24 hours a day, 7 days a week. To enter the sweepstakes in person, please visit one of the Levenger Retail Stores in Florida, Chicago, Boston or Virginia and complete an entry form. An eligible entrant may use any entry method. Limit one entry per person during the Entry Period. Multiple entries submitted by a single person, whether in-store, or via phone or Internet, are void. Non-winning entries received at any time during the Entry Period and prior to any prize drawing will carry-over as entries to the next prize drawing.
CONDITIONS OF ENTRY: Eligible entrants must enter via either phone, online, or in-store methods as described above.
Incomplete entries are void. By entering, entrants acknowledge compliance with these Official Rules,
including all eligibility requirements. An online entrant must be the registered subscriber of
the e-mail account by which the entry is made. All entries become the property of Levenger
Company. Neither Levenger Company, nor its affiliates, subsidiaries, divisions, advertising
and promotion agencies, or any telephone network or service providers are responsible for
incorrect or inaccurate transcription of entry information, or for any human error, technical
malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line
failures of any telephone network, computer equipment, software, inability to access any
Web site or online service, or any other error or malfunction, or late, lost, postage due,
illegible, or misdirected entries. Entry materials that have been tampered with or altered are
void. HOW TO WIN: In each calendar quarter of 2009, one (1) entrant will be selected as the prize winner
(the “Winner”). The drawing for one (1) Winner shall be conducted on each April 2, 2009,
July 2, 2009, October 1, 2009 and January 1, 2010, by a representative of Levenger Company by
random drawing from among all eligible entries received. The decisions of the judges on all
matters relating to compliance with rules, eligibility and the winning entries shall be final
and binding upon all parties. The odds of winning will be determined by the number of eligible
entries received. Limit one (1) prize per personal and one (1) winner per household. Winners
will be notified via email or telephone and must meet all eligibility requirements including
the execution and return of all necessary releases. Winners should receive their prize within
thirty days of notification.
PRIZES:
Total estimated retail value of all prizes: $2,000. This sweepstakes is being promoted on and entries are being accepted from the following Internet Web site www.levenger.com: Any taxes on prizes won will be the sole responsibility of the Winner. No substitution or transfer of prizes permitted except by Levenger Company.
ALL PRIZES WILL BE AWARDED AS IS: All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.) No substitution of prizes will be permitted except by Levenger Company, who may substitute a prize of equal or greater value. Prizes are non-transferable and may not be redeemed for cash. WINNERS: By entry into this sweepstakes, Winners consent to the use of their names, identities, and/or photographs for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. Limit one (1) prize per person and one (1) winner per household. If, in the judges' opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the sweepstakes, or if technical difficulties compromise the integrity of the sweepstakes, the judges reserve the right to terminate the online portion of the sweepstakes and conduct a random drawing to award the prizes using all phone, in-store and online entries received as of the termination date. Should the sweepstakes be terminated prior to the end of the stated Entry Period, notice will be posted at http://www.levenger.com, in our retail store and by phone. Any attempt to deliberately damage the content or operation of this sweepstakes is unlawful and subject to legal action by Levenger Company or its agents. All Winners will be required to sign an Affidavit of Eligibility and Release of Liability for Participation and Publicity prior to and as condition of acceptance of a prize. Failure to return documents as specified, or if prize notification is returned as undeliverable will result in the entry being disqualified and an alternative Winner selected. All prizes must be claimed within 30 days of drawing or alternative Winners will be selected. WINNERS LIST OR OFFICIAL RULES: For a list of Winners, available after April 2, 2009, July 2, 2009, October 1, 2009 and
January 1, 2010 or a copy of these Official Rules, mail a self-addressed stamped envelope
(residents of WA and VT need not include return postage) to Attn: Contest, Levenger, 420 S.
Congress Avenue, Delray Beach, FL 33445. Please specify whether you are requesting the Winners
list or the Official Rules. Requests received after April 2, 2009, July 2, 2009, October 1, 2009
and January 1, 2010 will not be honored.
ELIGIBILITY: United States law governs this sweepstakes. This sweepstakes is open only to legal residents of the United States, 18 years of age or older at time of entry. Employees and their immediate families, including household members, of Levenger Company, its affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible. This sweepstakes is subject to all federal, state, and local laws of the United States. Void where prohibited. Winners agree that Levenger Company, its affiliates and their agencies and employees shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion or from the acceptance or use of any prize awarded. Levenger Company reserves the right to verify eligibility qualifications of any Winner.
